At first glance, enforcing a twenty-year expiration on patents while treating physical property—such as land, real estate, or capital—as perpetual assets seems inherently unequal. Both physical real estate and intellectual property involve first-mover advantages, where early entrants secure valuable assets and leave latecomers at a competitive disadvantage. Why, then, does the law recognize perpetual ownership for physical property while imposing a strict, mandatory statutory limit on patent rights? To prevent chaos, conflict, and the depletion of scarce goods, legal systems grant perpetual physical ownership, ensuring clear boundaries and long-term stewardship.

Conversely, knowledge and technology are non-rivalrous public goods. One person utilizing a mathematical formula, a vaccine formula, or a mechanical design does not prevent millions of others from using the exact same knowledge simultaneously. Knowledge is never depleted through use. Because physical property is naturally scarce, perpetual ownership preserves social order. However, because knowledge can be infinitely replicated at virtually zero marginal cost, granting perpetual exclusivity over an idea would artificially restrict societal benefit for no physical reason.

Physical Preemption versus the Monopoly of Human Thought

The nature of a “first-mover advantage” differs vastly between physical assets and patented inventions. When an individual acquires a specific piece of real estate, latecomers are excluded from that specific physical location. However, latecomers remain free to acquire adjacent land, construct taller structures, or utilize alternative physical resources. Physical ownership restricts spatial access, not human creativity.

In contrast, a patent grants exclusive control over a scientific principle, chemical reaction, or logical method. If patent rights were perpetual, an early entrant who patented a fundamental concept—such as wireless data transmission or genetic editing—would legally bar all future human beings from independently utilizing those natural laws. While the monopoly of physical property limits where people can operate, a perpetual patent monopoly would limit how people can think, innovate, and solve problems. It would transform a temporary incentive into a permanent tax on human intellect.
